Reporting energy transactions to ACER

If you are an energy market participant, you need to report all of your transactions and orders-to-trade to ACER, the European Union Agency for the Cooperation of Energy Regulators.

Obligation to report to ACER

You are required to report to ACER (European Union Agency for the Cooperation of Energy Regulators) if you are an energy market participant , and if you meet one or more of the following conditions:

  • You close supply contracts and place orders-to-trade for electricity, natural gas and/or LNG in the European Union.
  • You close contracts for the storage of electricity, natural gas and/or LNG in the European Union.
  • You close contracts for the transportation of electricity and natural in the European Union.
  • You trade derivatives of such contracts: the right to sell or buy something at a certain price.

Exceptions

Reporting to ACER is not required in the following situations:

  • You produce energy with a maximum installed capacity of 10 Megawatt (MW) in electricity or 20 MW in natural gas, and you do not close your supply contracts on an energy exchange. ACER is allowed to request your transaction data.
  • You only trade in financial instruments. You report these transactions in accordance with European Market Abuse Regulation (MAR) (in Dutch).
  • You have a maximum capacity of 600 Gigawatt (GWh) in electricity or natural gas per year, per consumption unit.

Reporting energy trade

If you are required to report under REMIT, you need to report all of your transactions and orders-to-trade to ACER.

You can have an Registered Reporting Mechanism (RRM) do this for you, which is an organization approved by ACER to submit trading data on behalf of others, or you register as an RRM with ACER yourself.

Example

You trade on an energy exchange, and have the exchange report your orders and transactions for you. Energy exchanges are RRMs, and must offer you this service.
